NASHVILLE, Tenn. -- The Tennessee Attorney  General's Office won't appeal the reversal of Cookeville used-car dealer Fabien Eldridge's attempted-murder conviction for the 1992 slugfest he had with  Robert Fahey, and the prosecutor is unsure whether a new trial will take place.

Assistant District Attorney General Ben Fann, who originally prosecuted the case with private prosecutors David Day and Mike Knowlton, sad Tuesday he was not involved in that decision. "I'm staying away from that one, " Fann told The Pit.

The attorney general's office had 60 days to appeal the reversal, but the time ran out last week. Meanwhile, allegations in a $30 million civil rights suit filed by Eldridge last year in federal district court in Nashville naming Gibson, Fann, Day and Knowlton for their roles in the prosecution appear at least partially bolstered by the opinion.
